These SMS Terms of Service (“SMS Terms”) govern your receipt of SMS/MMS text messages from Divcon LLC (“Divcon,” “we,” “us,” or “our”). By opting in to receive text messages from Divcon, you agree to these SMS Terms.

1) Consent / Opt-In

By providing your mobile number and completing our opt-in process, you affirmatively agree to receive SMS/MMS text messages from Divcon at that number, including recruiting and candidate communications and internal employee communications. These messages may be sent using automated technology, and we will identify Divcon as the sender, except in the context of an ongoing conversation thread where the sender is already clear.

Consent is specific to Divcon and is not transferable, and you represent that you are the account holder of the mobile number provided, or that you have authorization from the account holder to enroll that number. Consent to receive text messages is not a condition of employment or of consideration for employment or engagement with Divcon. We maintain records of opt-in consent, and if we do not send an initial message within a reasonable period after you opt in, we may reconfirm your consent in our first message.

2) Message Frequency

Message frequency varies depending on your interactions with Divcon (for example, active recruiting or employment-related communications).

3) Costs

We do not charge for these text messages, but message and data rates may apply as determined by your mobile carrier and plan.

4) Opt-Out

You can opt out at any time by replying STOP to any message. After you opt out, we may send one final message confirming your opt-out, and after that you will not receive further messages unless you opt back in. To opt back in (where available), reply START or follow the instructions provided.

6) Privacy; No Sharing of Mobile Information for Marketing

Your participation is subject to Divcon’s Privacy Policy: divconcontrols.com/policies/privacy-policy, which includes a section describing our SMS/MMS text messages in more detail. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Message Content Monitoring (U.S. and Canada)

For messages sent to U.S. and Canadian phone numbers, our messaging service providers may collect and monitor message content to detect spam, fraudulent activity, and policy violations. By participating, you acknowledge this notice and consent to such processing for these purposes.

7) Delivery; Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network and your device.

8) Compliance

We will only send text messages consistent with the opt-in you provided and applicable law. We do not send content that is illegal, harmful, fraudulent, or otherwise prohibited, and we do not attempt to evade carrier or platform filtering. If you believe you received messages without consent, contact us using the support information above.

9) Changes or Termination

We may modify or discontinue these text messages at any time. We may also update these SMS Terms by posting a revised version with a new effective date, and continued participation after changes become effective constitutes acceptance of the revised SMS Terms.

10) Limitation of Liability

To the extent permitted by law, Divcon and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of these text messages, and Divcon’s total liability for claims related to these text messages will not exceed $100.

11) Governing Law

These SMS Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.
